Hi, I’ve got a house purchase running for me to buy a new property, and the owner wanted to exchange on may 8th and complete on the may 17th.

I’m a cash buyer so I’ve been ready to go for weeks now. My soliciter has just called me saying that after 3 weeks they have had no contracts and as a result, they still cant do the searches. Searches are taking 2 to 3 weeks to come back so I’m never going to hit the 7th for exchange.

The owner has found out and gone mad, saying he’s going to withdraw completely as he’s in a chain and if we cant exchange on the 7th he’ll have to break it. This leaves me having spent money with my soliciters, structural engineers and surveyors to the tune of £1200.

What can I do? His soliciters have had everything they need for four weeks now and just haven’t done anything with it, and thats the only reason its going to fall apart. Can I sue them for the money I’ve spent as it’s down to pure laziness on their part?
Edit, not sure if I was clear, my soliciters are going hell for leather to get the documents, it’s the sellers soliciters that are dragging their heels.

We are trying to buy a house and the title search showed many tax liens by the IRS. Turns out the sellers won’t net enough to pay the lien. We have verbal assurace that the IRS has agreed to the sale, and the sellers submitted all the paperwork. But how long does it typically take for the IRS to respond? The IRS told the title agent a min of 15 days. Does anyone have any experience with this?
So, we didn’t know about the liens untill the title search. We were told the sellers finally submitted all their paperwork to the IRS. The title agent has spoken to the IRS personally. The sellers owe more than they will clear. So, do I count 30 business days after they turned in all the paperwork? They’ve already had to pay for one extention to our loan lock.

15 days? In your dreams! The seller will have to submit an Application for Discharge of Property from Federal Tax Lien. Putting the application together is no cakewalk. I recommend to my clients that it be done as soon as escrow is opened because it ordinarily takes at least a month to get approved. If you make the requests 15 days before closing it is not going to be done and the sale may fall apart. IRS generally has a backlog and everybody wants theirs done yesterday so don’t ask to jump to the head of the line.

UPDATE: Plan on a wait of at least 30 days from the time the application for discharge was submitted.

We are still using achaic slow costly methods of house sales in an age when "cars" have been bought and sold for 125 years with a "log book" yet this item is mobile and is open to all kinds of fraud, a static thing called "a house", requieres a search and all manor of other things so that the conveyencing can look justified
a simple "log book" could contain all that was necessary in one sheet of paper. Why does a search have to be done every time a house is sold every detail regading that house could be on file with the land registry and the house could be sold similar to a car,, after all some cars are more expensive than houses

There is a ‘log book’ for a house…it’s called the ‘Title Information Document’ and is issued by HM Land Registry.

This documents guarantees ownership of the property..nothing else to search as far as ownership is concerned.

The syetem for transfering ownership of a property is very simple indeed and can be done in half an hour or so with just a few simple forms (obtainable via the web).

It’s solicitors that make it seem complicated so they can charge you more.

A friend of mine told me he was going to move to Detroit, because you can buy a house for $20K there. At first I didn’t believe him. But today I went to search houses for sale in Detroit and was shocked to see nice houses ranging from $15K to $60K and real palaces for $140K. Why are they so cheap? Is there a reason behind this price drop? Is Detroit a polluted or a dangerous place?

Oversupply.

Crime.

Lack of jobs.

Lack of services coupled with high taxes. I wouldn’t send a child of mine to Detroit City Schools.

The houses that sell for $20,000 sell for that little because they aren’t worth it. They are generally run down and dangerous. The land they sit on is often worth more, but you have to knock the structure down to get the land value out.

More people are trying to leave Detroit and Michigan than want to go there. This is because of the jobs situation (tied to the auto industry).
