who should pay the retaining wall for a new house, builder or new buyer?

The builer and sale managers never mentioned the retaining wall. After the foundation is created, we found that from the foundation line/base to the fence line/base, total long is about 20 feet and sloped elevation is 3feet 2 inches.
Would you please let us know who should pay this retaining wall?

first off, you had no control over the location of the home on the lot, the elevation of the foundation on the lot or the final grading requirements for the lot, so it is 100% on the builder, not the buyer. The builder also had a legal obligation to disclose that the lot required a retaining wall. Having said that, typically a retaining wall is required if the slope on the lot exceeds a 3 to1 ratio, and it doesn’t sound like that’s your case. Either way you shouldn’t have to pay. That’s absurd. Tell them to keep their house. You may also just go to the top and speak to the general manager. As a former production manger, I can assure if the general manager has to get involved because his people have failed to do their job, it usually hits the fan.

There is this bungalow for sale with near me. It is in a prime location and come with a substantial plot of land. But the building is hideous 80′s bad council design.

It has been on the market for 18 months..

I would like to buy the property for the land knock it down and build my dream home.

How can I be sure that I would get permission before I purchase.

(UK) You can NEVER guarantee planning permission, however straight forward the proposal. In principle a knock down and re-build are normally acceptable, although can depend on so many factors, so never take anything for granted. It is some type of secret book that this guy releases every couple of years because he doen’t want every one making the money he does on these houses. How can I attract buyer to look at my house?

I put my house for sale and I bought a new house. but it’s been almost a year now my house is still for sale. My house is in very good shape, new paint and some upgrade inside. Should I take the for sale sign in my yard and wait. Any idea?…help..please. Oh yes I have a realtor which I guess is not a lot of help..

Having an inexperienced Realtor who is NOT honest with you about pricing, staging & market conditions is what is not helpful.

You need to find a new agent, one who is honest with you about current market conditions, trends & most importantly pricing.

There is ALWAYS only 1 reason your home is not selling, I know you don’t want to hear it, but, you’re OVER PRICED.

With your new agent that you choose, pretend you’re the buyer, take a ride with them & check out your competition. See what they have that you don’t, what do they have that you do, for the price.

Maybe they have granite counters & you have formica?

Maybe they have neutral carpeting & yours is green?

or the opposite.

How long can you afford 2 mortg. payments.

Get the facts, look around,, change Real Estate Companies.

If you bought & moved into your new home & the one your trying to sell is vacant, try using some "staging" techniques, go to a "rent-a-center" or something like that, get a dining table, put place settings on it, get a couch & coffee table,

Sometimes it is difficult to for buyers to look at a vacant home without furniture in it, it’s hard for them to figure out "where will I put my china cabinet? will it fit there? how will it look? etc"

Yes you can put in an offer.

What you need to do is add a contingency clause to the offer that says your purchase of this house is contingent on the sale of your house. It is a pretty standard practice.

But, be aware of a few things. The seller may reject your offer, even if it is at the full asking price. There may be time frames involved, i.e you may have to agree that if you cannot sell your house in XYZ number of days, the seller can start looking for other buyers and can keep your earnest money, etc…

I say if you like the house, get your’s on the market with the same realtor that you will be using to list your property. Make sure that you have the contingency clause in your bid. AND!!! Make sure that you know and understand every detail of the contingency clause. It is never "that simple" do everything you can to minimize your financial risk. Also, given that you have a deadline, you may have to sell your house for a few thousand less then you could have gotten if you wanted to wait for the best offer.
